PRELIMINARY HEARING FOR NORMANDY SCHOOL TRANSFER STUDENTS SET FOR WEDNESDAY

 

WHAT: A preliminary hearing will be held for a lawsuit filed in St. Louis County Circuit Court on behalf of five Normandy students.  The lawsuit charges that the defendants in the case – Normandy Schools Collaborative, the State of Missouri, the Missouri State Board of Education, the Missouri Department of Elementary and Secondary Education (DESE), and the school districts of Francis Howell, Pattonville, and Ritenour – are in violation of Section 167.131 of the Outstanding Schools Act, which gives parents of children living in school districts without accredited schools the right to transfer their child to an accredited district in the same or an adjoining county.

 

Under state law, Section 167.131 RSMo. of the Outstanding Schools Act, a district is either accredited or students have the right to transfer.  The suit contends that the statute, which applies to a district that does not maintain accredited schools, applies to the Normandy Schools Collaborative as currently constituted.

 

Joshua Schindler, attorney for the plaintiffs, is seeking a preliminary injunction at this hearing that would allow the four plaintiffs to continue to attend accredited schools while the suit proceeds in the courts.

WHERE: St. Louis County Courthouse, Division 16, 4th Floor, 7900 Carondelet Ave., Clayton, Mo.

 

WHO:   The Honorable Judge Michael Burton will preside over the proceedings.

Children’s Education Alliance of Missouri (CEAM), the education reform group supporting the lawsuit on behalf of the plaintiffs, will issue a statement following the proceedings.
