A point of order was raised regarding the General Assembly’s ability to override a line item veto based on the opinion of Attorney General Chris Koster in recent days.

“The only harmonizing argument that you can conclude logically is that we do not have the authority to override the Governor,” Rep. Jeff Roorda said during a point of order on line item vetoes. “We are exceeding our authority. We are trampling on the Constitution.”

“I don’t think there is a clear interpretation if you read it honestly,” Rep. Jay Barnes said. “The gentleman from Jefferson has a cute point, but

“The fact is that many, many budget chairs have tried to override vetoes,” Rep. Chris Kelly said, supporting that that the point of order not be well taken. “Is it fundamental to democracy to attempt to override?”

Jones said that the Attorney General’s advisory is simply an advisory; the point of order against line item veto override attempts was not well taken.

The first line item to be overridden is reimbursing SAFE-CARE (Sexual Assault Forensic Exam-Child Abuse Resource and Education) providers for exams of those suspected to be abused.

“I believe we have sent the Governor an unbalanced budget,” Rep. LaFaver said. “It is the Governor’s duty to balance the budget.”
