Release: Hanaway Unveils Tort Reform Policy In Neosho

Hanaway Promises To Take On MATA and Liberal Judges

Neosho- While attending a town hall in front of an audience of 200, former federal prosecutor and gubernatorial candidate Catherine Hanaway announced her tort reform policies as part of her greater campaign pledge to Make Missouri Safe and Strong. Hanaway made the announcement as part of her Make Missouri Safe and Strong tour.

 

“When I’m Governor, the days of plaintiffs’ trial lawyers and liberal judges running jobs out of this state and farmers out of business are over,” said Hanaway.”Missouri has been rated as one of the worse judicial hellholes in the nation and frivolous lawsuits are keeping jobs and investment out of this state. These common sense reforms will restore power in our courts to every day Missourians and bring more jobs our state.”

–          Hanaway Supports a Constitutional Amendment That Would Require Direct Appointment and Senate Confirmation of Appellate Court Judges- Hanaway supports judicial selection reform to model the federal system with the Governor appointing appellate court judges and state Senate confirmation of appointments.

–          Stop Trial Lawyers Profiteering by Prohibiting the Attorney General From Subcontracting on a Contingency Fee Basis- Hanaway supports putting an end to the practice of subcontracting out attorney general cases to private attorneys on a contingency fee basis.

–          Put an End To Frivolous Lawsuits by Moving To Offer-of-Settlement Loser Pays System- Hanaway supports adopting a system where if a defendant offers the plaintiff a settlement that the plaintiff rejects, and the final judgment awarded is significantly less than the settlement offer, the plaintiff can be forced to pay the defendant’s legal bills from the time of the settlement offer.

–          Adopt Stricter Expert Witnesses Rules- Hanaway supports moving the state’s expert witness standard to the Daubert standard that is much stricter for expert testimony.

–          Reform Damages- Hanaway supports capping punitive damages including medical malpractice damages, eliminating joint and several liability and putting punitive damages towards a victims compensation fund.

Hanaway is a former federal prosecutor and House Speaker who is running for Governor to make Missouri Safe and Strong. To make Missouri economically Strong again, Hanaway will pass Right to Work, lower taxes and work tirelessly to implement this tort reform policy.
